In this privacy statement, we at Data Protocol explain what we do with any data we obtain in support of the Data Protocol app and related services. We recommend you carefully read this statement. We may update this privacy statement from time to time, as detailed below. You should not use Data Protocol’s platform or services if you have any objections to our privacy statement or Terms of Use, which are binding for all users. This privacy statement was last changed on March 30, 2023. 

If you have a question about how your personal information is being used, you can contact us through the methods provided in the “Contact details” section at the end of this privacy statement. In our processing we comply with the requirements of privacy legislation. ‍ That means, among other things, that:

  • we clearly state the purposes for which we process personal information. We do this by means of this privacy statement;

  • we aim to limit our collection of personal information to only the personal information required for legitimate purposes;

  • we first request your explicit consent to process your personal information in cases requiring your consent;

  • we take appropriate security measures to protect your personal information and also require this from parties that process personal information on our behalf;

  • we respect and recognize your rights to access personal information and have it corrected or deleted.

Contact, respond to an inquiry, provide our services, or process an order.

The following categories of data are collected

  • Identifiers, which may include name, phone number, email address, and other identifiers provided through webforms. We source this information directly from you.

  • Personal data categories contained in customer records, which may include name, address, telephone number, bank account number, credit card number, debit card number, or any other payment and financial information. We source this information directly from you.

  • Commercial information, which may include records of services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies. We source this information directly from you.

1.2 We use your data for the following purpose:

Registering an account

The following categories of data are collected

  • Identifiers, which may include name, email address, alias, and online identifier. We source this information directly from you.

  • Professional or employment-related information, such as information about professional certifications. We source this information directly from you.

1.3 We use your data for the following purpose:

Compiling and analyzing statistics for improvement of the Data Protocol application and related services, to screen for potential risk or fraud, and to protect and defend against misuse, such as excessive queries or any bot usage.

The following categories of data are collected

  • Geolocation data. We source this information directly or indirectly from you (e.g., from observing your activity in the application).

  • Internet, technical or other similar network activity, which may include usage and browsing history; browser type/version; operating system; device information, including device properties and IP address; and error logs. We source this information directly or indirectly from you (e.g., from observing your actions in the application). Please see our Cookie Policy for more information.

  • Personal data categories contained in customer records, which may include name, address, telephone number, bank account number, credit card number, debit card number, or any other payment and financial information. We source this information directly from you.

We only share or disclose personal information to other recipients for the following purposes:

  • Categories of personal information shared: Identifiers; Personal data categories contained in customer records; Internet, technical or other similar network activity

We also disclose personal information if we are required by law or by a court order, in response to a law enforcement agency, to the extent permitted under other provisions of law, to protect our rights, or for an investigation on a matter related to public safety.

We may share or transfer your personal information in the course of any direct or indirect reorganization process including, but not limited to, mergers, acquisitions, divestitures, bankruptcies, and sales of all or a part of our assets. Your personal information may be shared following completion of such transaction and/or during the assessment process pending transfer. If transferred in such a case, your information would remain subject to this privacy statement or a privacy policy that, at a minimum, protects your privacy to an equal degree as this privacy statement.

3. How we respond to Do Not Track signals & Global Privacy Control

The Data Protocol application responds to and supports the Do Not Track (DNT) header request field. If you turn DNT on in your browser, those preferences are communicated to us in the HTTP request header, and we will not track your browsing behavior.

4. Cookies

Our application uses cookies. For more information about cookies, please refer to our Cookie Policy on our Cookie Policy (US) webpage.

We have a data processing agreement with Google.

5. Security

We are committed to the security of personal information. We take appropriate security measures to limit abuse of, and unauthorized access to, personal information.  Please understand, however, that no data transmissions over the Internet can be guaranteed to be 100% secure due to the inherent risks of data transmission over the Internet. Consequently, we cannot ensure or warrant the security of any information you transmit to us and you understand that any information that you transfer to us is done at your own risk. If we learn of a security systems breach we may attempt to notify you electronically so that you can take appropriate protective steps. 

By using our application or providing personal information to us, you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of the application and related services. We may post on our application or via our website if a security breach occurs. We may also send an email to you at the email address you have provided. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

6. Third party websites

This privacy statement does not apply to third party websites or applications connected by links in the Data Protocol application. Please read the privacy statements for these providers prior to making use of these third party websites.

7. Amendments to this privacy statement

We reserve the right to amend this privacy statement. It is recommended that you consult this privacy statement regularly in order to be aware of any changes. If we make material changes to our privacy statement, we will notify you by prominently posting the changes here or by using the contact information you have on file with us. By continuing to use our application you are agreeing to be bound by any changes or revisions made to this privacy statement.

8. User Rights

All users of the Data Protocol application are entitled to the following rights:

8.1 Right to know what personal information is being collected about you

A consumer shall have the right to request that a business that collects personal information about the consumer disclose to the consumer the following:

  1. The categories of personal information it has collected about that consumer.

  2. The categories of sources from which the personal information is collected.

  3. The business or commercial purpose for collecting or selling personal information.

  4. The categories of third parties with whom the business shares personal information.

  5. The specific pieces of personal information it has collected about that consumer.

8.2 The right to know whether personal information is sold or disclosed and to whom

A consumer shall have the right to request that a business that sells the consumer’s personal information, or that discloses it for a business purpose, disclose to that consumer:

  1. The categories of personal information that the business collected about the consumer.

  2. The categories of personal information that the business sold about the consumer and the categories of third parties to whom the personal information was sold, by category or categories of personal information for each third party to whom the personal information was sold.

  3. The categories of personal information that the business disclosed about the consumer for a business purpose.

8.3 The Right to equal service and price, even if you exercise your privacy rights

We shall not discriminate against a consumer because the consumer exercised any of the consumer’s privacy rights, including, but not limited to, by:

  1. Denying goods or services to the consumer.

  2. Charging different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties.

  3. Providing a different level or quality of goods or services to the consumer, if the consumer exercises the consumer’s privacy rights.

  4. Suggesting that the consumer will receive a different price or rate for goods or services or a different level or quality of goods or services. However, nothing prohibits us from charging a consumer a different price or rate, or from providing a different level or quality of goods or services to the consumer, if that difference is reasonably related to the value provided to the consumer by the consumer’s data.

8.4 The right to delete any personal information

You have the right to request the deletion of your account and of the data collected from and about you at any time. We will delete all data, and direct any service providers to delete all data, within 90 days of your request.

We, and/or our service providers, may not be able to delete your data if maintaining your data is required to:

  • Deliver the service you requested

  • Prevent harm

  • Comply with a legal obligation

  • Investigate possible violations of our terms and policies

  • Promote safety and security

  • Protect ourselves, our rights, property, and products

  • Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided that information

If we cannot delete your data due to a lawful exception, we will notify you and include details about why your data could not be deleted. You have the right to request more information.

8.5 The right to opt-out of the sale of personal information

A consumer shall have the right to opt-out of the sale of personal information. We do not sell your personal information at this time, we do not share your personal information with third parties for their direct marketing purposes, and we do not sell the personal information of children under 16 years old.

8.6 Instructions for Data Deletion Requests

To request your data be deleted, visit the Contact link at the bottom of this page or use the contact methods provided in the “Contact details” section below. Please include your name, registered email, and username so that we can be certain that we do not modify or delete any data of the wrong person. You also have the ability to delete your data and account using the “Delete Account” menu option located in your Data Protocol profile. 

9. Data retention

We will retain your personal information for as long as needed to provide you services, comply with our accounting and legal obligations, resolve disputes, and enforce our agreements.

10. Children

The Data Protocol application is not designed to attract children and it is not our intent to collect personal information from children under the age of consent in their country of residence. We therefore request that children under the age of consent do not submit any personal information to us. In the event that we learn that a child has provided us with personal information, we will delete such personal information.

11. Consent to transfer

If you are visiting the Data Protocol application  from a location outside of the U.S., your connection may be through and to servers located in the U.S. Any information you provide during your visit will be processed and maintained on our servers and other internal systems located within the U.S. or otherwise as described above. You acknowledge that by providing your personal information to us, your personal information (i) will be used for the uses identified above in accordance with this privacy statement, and (ii) may be transferred to the U.S. as indicated above, in accordance with applicable law.
